These Terms of Service ("Terms") govern your use of apexefficiencylabs.com, any of its subdomains, and any other sales page, checkout or member area we operate that links to these Terms (together, our "Sites"), and any products, courses or services sold through them by Apex Efficiency Labs ("Apex Efficiency Labs," "we," "us"). By visiting our sites, creating an account or making a purchase, you agree to these Terms. If you do not agree, please do not use our sites or buy our products.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to make a purchase.
2. Our Products
We sell digital educational products, including courses, guides, templates, prompts and AI tools. Product descriptions, prices and what is included are shown on each offer page at the time of purchase. Your purchase gives you a personal, non-transferable license to use the content for your own use and your own business. You may not resell, share, redistribute, sub-license or publicly post our content without our written permission.
3. Accounts and Access
After purchase, you will receive login details or a link to access your products. Keep your login details private and do not share your account. We may suspend or end access if we reasonably believe an account is being shared, used for fraud, used to copy or scrape content, or used in violation of these Terms.
4. Pricing, Payment and Order Add-Ons
All prices are in U.S. dollars. Payments are processed securely by our payment provider, Stripe; we do not store full card numbers. Some offers include optional add-ons at checkout or one-click upgrades shown immediately after purchase. Each add-on or upgrade you accept is a separate purchase, charged to the payment method you used at checkout, and the price is shown before you accept it. You are responsible for any taxes that apply to your purchase.
5. Subscriptions and Automatic Renewal
Some products are subscriptions that renew automatically. Before you subscribe, the offer page will show the price, how often you will be charged, and that the subscription continues until you cancel. You will receive a confirmation email with these terms and instructions for cancelling. You can cancel online at any time at https://billing.stripe.com/p/login/00wfZieiT58rbD4cPs1Jm00 (enter the email you used at checkout and we will send you a login code), or by emailing [email protected]. Cancellation stops future charges and takes effect at the end of your current billing period; you keep access until then.
6. Refunds
Refunds are governed by our Refund Policy, which is linked at checkout and in the footer of our Sites and is part of these Terms.
7. Earnings and Results Disclaimer
Our products are educational. We do not promise or guarantee any income, sales, savings or other results. Any examples, figures or stories in our marketing are illustrations only and are not typical. Your results depend on your own effort, experience, market conditions and many factors outside our control. You are responsible for your own business decisions.
8. Intellectual Property
All content we provide, including videos, text, prompts, scripts, templates, designs and software, belongs to Apex Efficiency Labs or its licensors and is protected by copyright and trademark law. Except for the license described in Section 2, no rights are transferred to you.
9. Acceptable Use
You agree not to misuse our sites, including by attempting to gain unauthorized access, interfering with their operation, using automated tools to copy content, or using our products for anything unlawful.
10. Billing Questions and Disputes
If you have a problem with a charge, please email [email protected] first. We respond within two business days and will work with you to resolve it quickly, including any refund you are eligible for under our Refund Policy. This does not limit any rights you have with your bank or card issuer. If a charge is disputed, we may suspend access to the related products while the dispute is open, and we may provide our records of your purchase and product access to our payment provider.
11. Third-Party Services
Our sites and products may rely on or link to third-party services, such as payment processors, hosting and AI tools. We are not responsible for third-party services, and their own terms apply to your use of them.
12. Disclaimer of Warranties
Except as expressly stated in these Terms, our sites and products are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.
13. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim relating to our sites, products or these Terms is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential or punitive damages. Some jurisdictions do not allow these limits, so they may not apply to you.
14. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Diego County, California, and you and we consent to their jurisdiction. Nothing in this section prevents either party from bringing an eligible claim in small claims court.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Changes apply to purchases made after the update.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us about our sites and products.
